1. General Provisions
1.1 Services are provided specifically for the event type specified and none other; if the event type differs, DJ Allmightymix reserves the right to terminate performance.
1.2 The event date is not reserved until this contract (or a Retainer Agreement) is returned with the contract signing payment. The client will be informed if others are interested in the same date.
1.3 This contract is excused by detention of personnel due to sickness, accidents, riots, strikes, epidemics, Acts of God, Force Majeure, or Acts of War. DJ Allmightymix will make reasonable efforts to find replacement entertainment at the agreed fees; if unable to, the client receives a 100% refund of fees paid. In all cases, liability is limited exclusively to a refund of fees paid — no indirect or consequential damages.
1.4 DJ Allmightymix guarantees readiness to perform at the event's start time. No guarantee is made on arrival time for setup; access is requested at least 90 minutes before and after the event.
1.5 Governed by the laws of New Jersey and New York; any suit shall be filed in Bergen County.
1.6 Except for negligent acts by DJ Allmightymix's personnel, the client agrees to defend, indemnify, and hold DJ Allmightymix harmless from claims, damages, losses, and expenses pertaining to the performance.
1.7 In any civil action to enforce this agreement, the losing party pays the prevailing party's attorney's fees and court costs.
1.8 The client may not transfer this contract without DJ Allmightymix's prior written consent.
1.9 Not binding until signed by an authorized representative of DJ Allmightymix. Changes must be written and signed by both parties — oral agreements are non-binding.
1.10 If any clause is found illegal, the remainder of the agreement stays in force.
1.11 DJ Allmightymix's choice not to exercise a right does not waive that right for the future.
1.12 DJ Allmightymix acts as a subcontractor to the client, not as an employee.
2. Fees
2.1 Amount for Services is the total contract price.
2.2 The Contract Signing Payment is non-refundable and secures the date; it is subtracted from the total amount for services.
2.3 Balance is the amount remaining after the signing payment and any other payments made.
2.4 Schedule: payments may be made in increments up to 30 days before the event (more than $250/month permitted). Final payment is due in full 30 days before the event — if unpaid, DJ Allmightymix may reopen the date and cancel performance, and the client remains responsible for the full remaining balance. If the contract is signed less than 30 days before the event, full payment is due at signing.
2.5 DJ Allmightymix may pursue legal means to recover any unpaid balance, plus resulting court and legal fees.
2.6 A request to pay the balance on the day of the event must be received in writing at least 30 days prior; if granted, payment must be cash, cashier's check, or money order, paid before setup begins. If unpaid 15 minutes after the scheduled start, DJ Allmightymix and staff will leave and the client remains responsible for the balance.
2.7 A $100 fee applies to all returned checks.
2.8 Deposit Proof & Verification: the client must provide a deposit screenshot/receipt. The contract is confirmed only once the deposit is verified as received/cleared — a screenshot alone is not accepted as final proof. Falsified proof may result in cancellation and legal action.
3. Play List
3.1 A written music planner or request list must be received at least 14 days prior to be included in programming guidelines.
3.2 The planner should include a "Do Not Play" list of songs the client does not want played.
3.3 With or without a planner, DJ Allmightymix will attempt requests but isn't responsible if selections are unavailable.
3.4 Extra effort is made for requests received in writing 14+ days out; use of DJ Allmightymix's music selection system counts as "in writing."
3.5 DJ Allmightymix may add or substitute selections to increase dance participation, none of which will be on the Do Not Play list.
3.6 DJ Allmightymix may modify song order for appropriate presentation.
4. Venue Access
4.1 The client must provide immediate, unencumbered, nonhazardous access into, through, and out of the loading area, facility, and workspace.
4.2 Ramp or elevator access is required between parking/service entrance and setup area. If steps are the only access, a $10-per-step fee applies for 3 or more steps; DJ Allmightymix must be notified of step-only access before this contract is signed.
4.3 The client is responsible for any venue-imposed charges, including parking, electric power, and overtime for setup/takedown.
5. Working Conditions
5.1 A 6x6 ft area for the DJ setup, plus space for speakers; an additional 6x6 ft area for screen/projector if needed, positioned within view of most guests and 50 ft or less from the DJ area.
5.2 A 120-volt, 3-prong grounded outlet (15+ amps) within 50 ft of the setup area. DJ Allmightymix isn't responsible for ground-loop hum caused by venue wiring.
5.3 Full protection of equipment from adverse weather — sun, rain, wind.
5.4 Crowd control if warranted, directions to the venue, and free parking.
5.5 For outdoor events, a dry setup area is required; if the ground is soft, plywood must be placed in a 6x6 ft area. The client is liable for damages, injuries, or delays from failing to meet these provisions.
6. Safety of DJ Allmightymix's Personnel
6.1 The client must take steps to protect equipment, music, and personnel during the event. Damages from inadequate protection (absent DJ Allmightymix's gross negligence) are payable by the client, including repair/replacement and medical costs.
6.2 If a threat of injury arises, DJ Allmightymix may cease performance; if resolved within 15 minutes, performance resumes under the original terms. Full payment is owed regardless of resolution or resumption.
6.3 DJ Allmightymix may deny guests access to the sound system, recordings, or equipment to prevent damage or injury.
7. Cancellation
7.1 This agreement can only be canceled by mutual written consent.
7.2 If cancellation is agreed in writing, the client pays any unrecoverable costs already incurred (not exceeding the total fee).
7.3 Up to 45 days before the event: DJ Allmightymix keeps the Contract Signing Payment.
7.4 30–45 days before the event: DJ Allmightymix is entitled to 75% of the amount for services.
7.5 30 days or less before the event: DJ Allmightymix is entitled to 100% of the amount for services.
8. Photo Montages
8.1 All montage materials are due 15 days before the event.
8.2 A $50 late fee (cash, money order, or cashier's check) applies to materials received after that — unpaid, the montage won't be presented and the montage fee is retained.
8.3 Materials sent later than 10 days before the event may not leave enough time to develop the montage.
9. Song Content
9.1 DJ Allmightymix isn't responsible for foul or abusive content in songs or on-mic comments. Karaoke versions may star out words, but singers may still sing them aloud. Two language announcements will be made on request, but the evening can't be fully policed. Standard non-karaoke music is radio/censored versions.
Final Notice
This contract may not be altered, cancelled, assigned, or transferred without DJ Allmightymix's consent. Unauthorized changes void the contract and forfeit the signing fee.
